DLH: I do know that. I'm just a voice on the phone and a website on the internet. But from 2010
through 2017 I easily found people who could pay and volunteered to. That is the most insidious part
of the plan by Foreclosing Parties (Servicers, Imposters, and Fictitious Payees, ((UCC legal terms)),
etc. and the worst offenders, our judges. All along, the co-conspirators' plan has been to:
a.) (with the judges’ help) to wear you out;
b.) To take up your time;
c.) To cause you to remain in a state of anxiety for as long as it takes. (That much adrenalin damages your body and brain);
d.) To run you out of money;
e.) To fatigue you thereby sapping your strength
f.) And finally to crush your will to keep up the fight;.
I have never believed in Congress, or the President, but I have believed very deeply in the courts. Like everyone else, I believed if I could just get the judges to focus and try to understand what was happening, that the courts would straighten everything out.
That notion has cost all dearly. If judges had run their courts as directed by the constitution and defined by the Supreme Court since 1787, nobody's case would have taken more than 60 days to finish in the Borrower’s favor. There would have been 95% fewer cases.
For free, I have provided all of this on my website, at least whatever I knew at the time. I have used donate buttons for five years. I removed them off recently.
During the last five years, tens of thousands of people have visited the site. I received a total of donations of $25. In the last four months, my page views have gone up by 10X. I have never had more than 1000 page views in a month before. I have had over 10,000 per month for the last three months.
I have had dozens of people fill out my form and arrange a phone call. Almost always they have to tell me their whole story before they can even listen to me. I listen. I know that they are venting. They are frustrated and scared. They are also out of money. The call lasts as long as two hours and then they tell me that they have no money.
Two hours is an unaffordable amount of time to spend to just disappoint us both.
I have just described all the signs of an upcoming apocalypse. The increase in my page views tells us that foreclosures are way up. This has been during the moratorium for which we have no regulators to monitor and enforce. (remember the Repeal of Glass-Steagall with no replacement regulations).
The moratorium will eventually be lifted and the ensuing foreclosure numbers will be at an all-time high. The central target will be those that have fought the hardest and the longest. These are also the Borrowers that these bad guys know well. They know that these targets are also out of money. That they cannot withstand another attack.
Knowledge of how to stop them is the weapon. Money is the ammo. Without awareness of this problem, we can't stop them.
The whole thing isn't about the laws. It is about outlaws. This takes an entirely different strategic plan for winning.
Last night I held a Zoom Discussion group. The topic was how to help the Borrowers who were out of cash and exhausted.
I had a normal amount of interest. I still expected attendance to be more than ten attendees. It was three. The biggest problem facing Borrowers is money. Judges have slipped to #2.
But no one cared to check out raising money. I had two credible thoughts. I had no plans to pitch my services. I was donating my time. I don't know why more people weren’t more interested in attending.
Maybe people are going through the motions of looking for a miracle on Facebook, but they are too despondent to believe in anything. Certainly not a credible answer.
I have gone on with this rant, Cindy, for longer than I had intended. I went this long because I began to see this as a good article to post. I will stop it soon and write an ending later. If you are still reading, I want to tell you that I am not upset with you in any way. I can't pitch you on me. I promised myself in 2012, that I would not do that. So, sometimes I help more than I intended because I don't want to let people down.
I did help you more than you think by just telling you to stop. Clear your head. Stand and stare at the problem. You said in one of your messages that you were trying to make sure that you were writing something "Court worthy". But, you were going to present it to a judge who is not going to read it.
This isn't about money to me (well up to a point). That is not what I meant. It is about time. I am writing my own stuff now.
I have a lot, my house and investment property that yielded take home rent money exceeding $9,000 per month. I want my cases filed into court yesterday. I want my life back also.
It is about fair trade. I am out of money. But, I know the best way to get this done and have a very good chance of winning. I need to pay my monthly bills which are startlingly low when compared with the rest of my life. I am doing one of my four properties right now plus the cases of two paying clients.
I can do two more. But, that would put a real strain on me in workload, mentally, and physically. I would only dare to do take on more if it helps me to get this done fast. If it doesn’t help to pay my monthly bills, I will lose electricity and the use of the internet. I can help nobody in that scenario.
This is no longer an endurance race.
It is now a sprint.
I can't stand the suspense much longer.
At this moment I won't consider less than $900 per month for two months and for that, I will:
a.) write what you need to file now and
b.) I will write the reply to the response to your lawsuit or motion that the foreclosing party must file, or face a default judgment in your case.
c.) Then if still needed I will write the lawsuit against the judge who is just a plain old citizen at the time that he moved your case forward without reviewing Standing which is required for him to conduct your case.
d.) If your home is in a Non-Judicial state and you have never filed your lawsuit (petition, complaint, etc), then you have never used your civil right to set aside and vacate your wrongful foreclosure. That must be done ASAP! It is a defensive and offensive move.
What are the counts that you might include in your case? This is my current list. It is subject to change if I decide it is too much, or too little:
Wrongful foreclosure
Lack of Standing, and therefore Absolute Lack of Subject Matter Jurisdiction
Deprivation of Constitutional Civil Rights Under Color of Law
(Due Process; The Right to be sued only by someone who has proven they have met the requirements to take a case before any court. (There are no foreclosing parties that can meet the requirements of Standing)
Obstruction of Justice
Civil Violation of the Racketeering Influenced Corrupt Organizations Act (RICO)
Unjust Enrichment
Request for Mesne Damages (pronounced main)
Quit Title
Maybe more. I have 2 TB of weapons. But simpler is better. I will never ask for more money later. But I will continue with you and do my best until we are beaten or have won.
I don't expect you to say yes. But, I wanted you to know this is not a one filing and done deal.
We have to set up the judge by clearly warning him of your intentions should he violate his oath to uphold and protect the Constitution and to always act in a manner that encourages the public perception and confidence in the integrity of the courts in the first filing.
Then we need to pitch an inside fastball at the head of the Defendants. Maybe a proposed amended Complaint which includes RICO. Whether we win or not with it.
I won my biggest case with that kind of proposed Amended Complaint. I just added RICO. It was against Hudson City Savings. After six years they just never responded. A Missouri State judge gave my guys a default judgment and $2.5 million punitive damages. The ruling is on my website. I bet you didn't see it.
So, in conclusion, if you are not able or just not interested, I hope that I have helped you some, and I wish luck in whatever you choose to do.
If you are still interested, or if you want to know more, I would rather do it over the phone. I hate typing on little bitty keys.
